Terms of Service — Australia

This page supplements our main Terms of Service with provisions that apply specifically to Australian users, including non-excludable rights under the Australian Consumer Law (ACL). In case of inconsistency, this Australia-specific addendum prevails for users in Australia.
1. Who We Are
mealPlan.fit is a service of Simple Apps, a business registered in India. These terms form a binding agreement between you (the customer) and Simple Apps.
2. Australian Consumer Law
If you are a “consumer” within the meaning of the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)), you have rights that cannot be excluded, restricted or modified by these terms, including guarantees as to acceptable quality, fitness for disclosed purpose, and services rendered with due care and skill.
Nothing in these terms or our main Terms of Service is intended to exclude or limit those rights. Where our main Terms limit liability or disclaim warranties, those limits apply only to the extent permitted by the Australian Consumer Law.
3. Subscription and Pricing
- Prices on our AU site are in Australian Dollars (AUD).
- We are not currently registered for GST in Australia (turnover is below the A$75,000 registration threshold). We do not charge GST on subscriptions. When we exceed the threshold, we will register and update pricing accordingly.
- The 15-day free trial does not require a credit card. No charge is made unless you subscribe after the trial.
- Subscriptions are paid in advance (monthly or annual). Payment methods and billing mechanics are described at checkout.
4. Refunds and Cancellation
In addition to your Australian Consumer Law rights:
- Monthly plan: cancel anytime. Cancellation takes effect at the end of the current paid period; no pro-rata refund is provided for unused days in that period.
- Annual plan: within the first 30 days, you may cancel for a full refund. After 30 days, you may cancel at any time and we will refund unused whole months (pro-rated).
- Service failures: if the service materially fails to meet the consumer guarantees under the ACL (e.g., major fault, not fit for purpose), you are entitled to a refund, replacement, or remedy as required by law.

5. Your Data and Professional Responsibilities
mealPlan.fit is a practice management tool intended to be used by qualified nutrition professionals. It is not a medical device, does not provide medical advice, and is not a substitute for professional clinical judgement. You remain solely responsible for the clinical decisions you make using the tool.
If you are an Accredited Practising Dietitian (APD) or similarly regulated professional, you are responsible for complying with your professional body's record-keeping and scope-of-practice requirements. We support this by providing full data export and 7-year retention options.
6. AI Features — Scope and Limits
Where we describe features as “AI-powered,” those features are designed to assist your workflow (e.g., extracting values from lab reports, generating meal plan drafts, calculating nutrient totals). They do not diagnose, assess risk, predict disease progression, or recommend clinical interventions. All AI outputs must be reviewed and approved by you as the qualified practitioner before being relied upon or shared with a client.
7. Governing Law and Jurisdiction
These terms are governed by the laws of India. However, Australian consumers retain the right to bring proceedings in Australia where required by applicable consumer law, and nothing in these terms deprives you of that right.
